TO REQUEST MEDICAL RECORDS
The Maryland State Police Aviation Command maintains detailed medical records on medevac patients flown aboard the Department's helicopters. These records are protected under the Health Insurance Portability and Accountability Act (HIPAA) of 1996, Public Law 104-191; as well as other State laws and Departmental policies.
Attorneys and other authorized persons-in-interest may obtain copies of medical records on medevac patients flown aboard the Department's helicopters by utilizing the following procedures:

2. In accordance with HIPAA, all requests must be accompanied by a signed HIPAA release by a patient, a patient's duly authorized representative, or a representative of the estate of the patient. The Aviation Command will also respond to a subpoena duces tecum or other lawfully executed court order.
3. In your written correspondance, please provide as much information as possible about the incident, to include patient name(s), date/time/location of incident, type incident, and destination hospital, if known.
4. There is no charge for this service, however, providing a self-addressed, postage-paid envelope will defray our expenses and expedite our reply.
5. Time critical requests may be faxed to 410-238-5816, however, all HIPAA requirements must still be fulfilled. All responses by the Aviation Command will be via US MAIL ONLY.
6. Persons desiring to retrieve records in person must contact the Custodian of Records in advance. Such records will be released by prior appointment only, and only to HIPAA-authorized persons-in-interest. Positive identification will be required. Contact 410-238-5863 for additional details.
NOTICE TO AFLAC AND OTHER SUPPLEMENTAL INSURANCE CUSTOMERS: AFLAC and other supplemental insurance providers typically provide additional cash benefits to policyholders who required air transport. Upon written request, the Aviation Command will provide a confirmation letter to the policyholder whose insured was a medevac patient flown aboard a Department helicopter. Please follow Instructions 1, 3, and 4, above. No medical information is disclosed in a confirmation letter, only verification that the patient was flown to a medical facility from a location at the specified date and time. AFLAC and other supplemental insurance providers generally provide the applicable benefit upon receipt of our verification letter.
